Still in the consultation phase, this act presents a courageous step by the Liechtenstein Financial Center towards promotion and support of the growing “Token Economy” surrounding crypto currencies and blockchain based technology.
We are also proud to inform you that our law firm was significantly involved in both the drafting of the law as well as ensuring the utmost care was put into its English translation. That being said, the English translation is strictly for informational purposes and the German version of the act will be the only version possessing legal significance.
Focusing on Trustworthy Technologies, the “TT Act” provides a legal framework that is the first of its kind, ultimately encompassing all areas of the “Token Economy.” Instead of distinguishing between different kinds of tokens, the act provides a catchall definition encompassing all categories of tokens within this ever changing and growing industry.
Creation of legal certainty in the “blockchain” area only serves to make Liechtenstein an even more attractive financial center, solidifying the Principality’s place as a blockchain friendly jurisdiction. Furthermore, the regulatory authority responsible for carrying out the act is the Financial Market Authority (FMA), the same authority responsible for ensuring this country’s success as a Financial Center.

Das sich noch im Vernehmlassungsstadium befindliche Gesetz stellt einen mutigen Schritt des liechtensteinischen Finanzplatzes dar, die wachsende „Token-Ökonomie“ um Kryptowährungen und blockchain-basierter Technologien zu fördern und zu unterstützen.
Wir können ihnen zudem erfreut mitteilen, dass unsere Kanzlei stark in den Entwurfsprozess hinsichtlich des Gesetzes eingebunden war und dessen englische Übersetzung sorgfältig erarbeitet hat. Anzumerken ist allerdings, dass die englische Übersetzung ausschliesslich Informationszwecken dient und die deutsche Version des Gesetzes die einzige rechtserhebliche Version darstellt.
Durch den Fokus auf Vertrauenswürdige Technologien stellt das „VT-Gesetz“ als erstes seiner Art einen Rechtsrahmen bereit, das letztendlich alle Bereiche der „Token-Ökonomie“ umfassen soll. Statt zwischen verschiedener Arten von Token zu unterscheiden bietet das Gesetz eine Definition, die alle Token-Kategorien im Rahmen dieser sich laufend verändernden und wachsenden Branche erfasst.
Durch die Schaffung von Rechtssicherheit im Blockchain-Bereich soll Liechtenstein ein noch attraktiverer Finanzplatz werden, wodurch die Position des Fürstentums als blockchain-freundliche Rechtsordnung gefestigt werden soll. Darüber hinaus soll die Finanzmarktaufsicht (FMA), welche für die Sicherstellung des Erfolgs des Landes als Finanzplatz mit verantwortlich zeichnet, zuständige Aufsichtsbehörde im Rahmen dieses Gesetzes sein.
Wir hoffen, dass diese englische Übersetzung für diejenigen hilfreich ist, die ihre blockchain-basierten Unternehmen nach Liechtenstein bringen möchten, sowie für andere Rechtsordnungen, die Liechtenstein hinsichtlich der Schaffung von einschlägigen Regelungen folgen möchten.
